Threatening and Intimidation Dismissed
Threatening and Intimidation misdemeanor charge dismissed as client was acting in self defense to a trespasser.
A person entered the home of client and began an argument. Client, the home owner, told the person to leave. The person refused to leave and client advised that he would forcible remove the person from the residence. Client was charged with the misdemeanor crime of Threatening and Intimidation. A person who was not entitled to be on the property and asked to leave the property may not refuse thus becoming a trespasser. Trespass is a crime and reasonable self help to remove a trespasser from the client's home is allowed.
The charge of Threatening and Intimidation was dismissed.
