Misconduct Involving Weapon- Prohibited Posessor

The State mus prove that the accused knowingly possessed a prohibited or deadly weapon and was a prohibited possessor at the time of possession of the weapon.

A deadly weapon is anything that is specifically designed for lethal use such as a firearm. A firearm is any loaded or unloaded gun. If the firearm is a permanently inoperable condition is not considered a firearm.

Knowingly means that a person is aware or believes that the person's conduct is unlawful.

Possession is a voluntary act if the defendant knowingly exercised dominion or control over property.
